Information to Prepare a Design Application
If you wish to register the look of your product as a register design, we require the following information:
- The full names, addresses and nationalities of each of the proprietors of the design. A proprietor can be a person or a company.
- A brief description of the article (or set of articles) to which the design is applied.
- Representations showing the design from multiple viewpoints, e.g. a "top view", "bottom view" and "side view" of the article. The most appropriate viewpoints will depend on the nature of the design and the article to which it is applied. The representations will preferably be line drawings of draughtsperson quality without any dimension lines. Alternatively, the representations can be photographs of the article taken against a plain background.
Under the Australian and New Zealand Designs Acts, the author of a design will be treated as the proprietor of the design unless the design was executed by the author for another person for good consideration, in which case, that other person will be treated as the proprietor. The right to apply for a design can also be transferred by way of an assignment or other agreement.
